Representation regarding Exservicemen entertained by DOP&T
Sir, your actions are praiseworthy. At the same time, I would like to suggest one thing. Please read Para 16 of DOPT Orders, 1986. It says that pay of ex-combatant clerks of Armed Forces on their initial re-employment as LDC/Junior Clerk, will be fixed duly invoking FR 27 (advance increment). It means they will be given No. of increment in the entry pay of re-employed post, for No. of years spent in military service. The problem is that the rule was issued in 1986. Thereafter, many govt departments have changed the nomenclature of LDC/Junior Clerk. Even DOPT has changed the nomenclature of LDC as Junior Secretariat Assistant in Dec 2015 and Supreme Court has changed the nomenclature of Junior Clerk as Junior Court Assistant. Lower Courts also call their LDC/Junior Clerk as Junior Judicial Assistant. On the pretext of nomenclature, various departments are not fixing our pay. Moreover, there is no policy letter, wherein pay scale of LDC/Junior Clerk has been mentioned. The scale of Junior Clerk is also different in various departments. It has become a bone of contention for pay fixation. Even after getting clarification from MOD to fix the pay, departments are again asking DOPT for clarification and delaying it. It is therefore requested that a case may kind be taken up with DOPT or you may like to speak to Sh. Pushpender Kumar, Under Secretary (DOPT) to bring this aspect in his knowledge. They may change the word like -- Ex-combatant clerks/storemen on their re-employement to non-gazetted post in civil side will be eligible to get the benefit of Para 16.
One more issue I wish to bring to your notice, since MOD/PCDA, Allahabad and DOPT vide Para 4 (d) of their OM dt 05 Apr 10 states that pension of PBOR below 55 years of age will be fully ignored when fixing the pay. It should not be a separate para. while amending Para 4 (b) (ii), they must insert that pension of PBOR who are below 55 years, would be fully ignored. so that it may not create ambiguity.

I spoke to Mr. Pushpender Kumar, US. They are going to issue the fresh O.M. They will rectify the aforesaid problem of nomenclature, pay scale etc. when our association sent a representation atleast to JS (Estt). Hence, I would again request to Mr. Vikas De, to send/fax a letter immediately to change it. It is astonishing and offending that Para 16 Sub Para 2 of DOPT letters says that service rendered in armed forces as combatant clerks/storemen will be treated as Junior Clerk/LDC. A person puts 24 years service and gets 4200/- Grade Pay in the rank of Nb/Sub or Sub. How can he be treated as LDC/Junior Clerk.

The undersigned is directed to refer to NFIR’s letter No.II/35/Part XIII dated 23.11.2016 on the above subject and to state that with the reference to Board’s letter of even number dated 7-12-2016 addressed to DOP&T pursuant to the discussion in the separate meeting on the issue held on 27-09-2016, DOP&T vide their OM No.1213833/2016-Estt(Pay-II) dated 21/2/2017 (copy enclosed) have clarified that the pay of non-commissioned ex-servicemen (PBOR) who retire from the Defence Forces before attaining the age of 55 years is to be fixed as per the entry pay in the revised pay structure of the re-employed post applicable in the Direct Recruits appointed on or after 1.1.2006 without any protection of last pay drawn, in accordance with prevailing guidelines vide para 4 of OM dated 31.07.1986 as amended vide OM dated 05.04.2010 which provide for methodology of pay fixation on re-employment.

Sir, It was really good to see some one fighting for one of anomaly and discrimination affecting large number of re-employed ESM. Outcome of meeting might affect lakhs of us. Why central government is looking our small pension which is already ignored and we are getting it after donating our life to Nation. Officers pension are not ignored because they are getting their last pay fixation on re-employment in government offices and their pay and pension may exceed the limit of Rs 250000/- ie the pay of secy to the GoI but JCOs/OR are not crossing even 1.5 lakhs (Pay + pension). DOPT is delaying and delaying cases of combatant clerks who have been re-employed in government departments as JAA/LDC or as junior clerk. There are various guidelines in the matter which needs a fresh order in the matter. I do not know that who will look in the matter ? Our central union has raised this point as welfare of ESM but now wait when it will be decided.
