Pay Protection-
It is the facility given to the Retd Commisioned officer (BABUs) and various GOVT of india order of 2010 and 2008 stands for it.
Pay fixation:- Employees of Banks,PSUs,RBI and insurance sectors get as per their last pay vide-GOI DOPT-No. 121312009-Pay-I dated 3oth March. 2010 and Department of financial services 4-3-2012-welfare dated 17/02/2014.

In civil also provision exist for all babus to get their last pay in re-joining.
How ever, the re-employed CG employes are NO WHERE...............
In this issue-
The govt is silent as (i) No body wants to pay more.(ii) The voice of Poor Jawans are not of the standard to reach the ears of GOVT.
The Ex Servicemen organisations are silent as (ii) The fear of danger to the facilities given to the Retd Commissioned officers are there.(ii) They still receive all the facilities in the name of Jawans and support from jawans is sufficient for their existence.
The DGR is silent- as every thing is correct in pen and paper.
Then........
Who will give justice to the Re-emplyed ESM who are paid the salary at the age of 45 years as equal to the new recruit of 18 years.
Other jawans and Commisioned officer drawing much more in other organisations because of the orders of same land(GOVT)..............
Let us find out the solution ,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,or else the parity and financial scarity will continue and we will have no powers even to fight.
POINT OF VIEW REGARDING PAY FIXATION CLARIFICATION ISSUED BY DOP & T TO DEPT OF POSTS BY EX SGT J K RAJPAL
1. THE DG POSTS HAS ASKED CLARIFICATION FOR PAY PROTECTION WHICH IS WRONG AS PAY PROTECTION IS A DIFFERENT SUBJECT.
2.THE SUBJECT HERE IS ADVANCE INCREMENTS EQUAL TO NUMBER OF YEARS OF SERVICE RENDERED IN DEFENCE FORCES BECAUSE OF UNDUE HARDSHIP BECAUSE OF PAY FIXATION AT MINIMUM OF THE SCALE OF THE POST AS GIVEN IN DOPT OM OF 1958.
3. FURTHER THE 1958 OM CLEARLY SAYS THAT IF APPOINTING AUTHORITY FEELS THAT BY FIXING PAY TO MINIMUM SCALE THERE WILL BE HARDSHIP TO INDIVIDUAL THEN ADVANCE INCREMENTS EQUAL TO NUMBER OF YEARS OF SERVICE SHOULD BE GIVEN AND PAY IS TO BE FIXED.
4. CALCULATION OF HARDSHIP IS CLEARLY EXPLAINED BY HON SUPREME COURT OF INDIA IN THE CASE OF DG POST VS B RAVINDRAN DTD 1996,COPY ATTACHED FOR PERUSAL.
5. THE HARDSHIP IS TO BE CALCULATED BY IGNORING THE IGNORABLE PART OF PENSION AND THEN THE PRESENT SALARY OF THE RE EMPLOYED POST IS TO BE ADDED TO LEFT OVER PORTION OF PENSION WHICH IS NOT IGNORED AND COMPARED TO LAST PAY DRAWN. IF IT IS FOUND THAT THE AMOUNT SO REACHED IS LESS THAN THE LAST PAY DRAWN THEN IT IS A CASE OF HARDSHIP AND ADVANCE INCREMENTS ARE TO BE GIVEN.
6.THERE ARE SO MANY CASES IN WHICH HARDSHIP IS DEFINED ,I AM ATTACHING THE CASES FOR REFERENCE AND HELP.
7. INDIAN RAILWAYS AND EPFO HAS GIVEN INTERPRETATION OF DOPT OM OF APRIL 2010.
8. BANKS ARE ALSO GIVING PAY FIXATION ON THE BASIS OF SAME RULES AND OMS.
9. I REQUEST YOU TO KINDLY GO THROUGH THE CASE OF DG POST VS B RAVINDRAN FOR BETTER FIGHT.
10. IN MY OPINION THERE IS ONLY ONE WAY THAT IS TO GO TO COURTS EITHER JOINTLY OR INDIVIDUALY. BUT BEFORE GOING TO COURT THE PREPAREDNESS SHOULD BE FULL WITH ALL THE EARLIER DICISIONS AND PRESENT EXAMPLES.
